INTRODUCTION
WayBeyond Limited and its subsidiaries (we, us, our) comply with the New Zealand Privacy Act 2000 (the Act) and the General Data Protection Regulation of the European Union (GDPR) when dealing with personal information. Personal information is information about an identifiable individual (a natural person). If you are based in the European Union (EU) and use our website and related services, the additional terms in the GDPR addendum to this privacy policy (Addendum) applies to you. This policy does not limit or exclude any of your rights under the Act. If you wish to seek further information on the Act, see www.privacy.org.nz. It does not provide exhaustive detail of all aspects of our collection and use of personal information. However, we are happy to provide any additional information or explanation needed. We are committed to respecting and protecting your privacy. All data related to a WayBeyond reseller’s business or a WayBeyond customer’s business is owned by the relevant reseller or the customer respectively – it is not WayBeyond’s. WayBeyond separates data into two categories - Account and Marketing Data and Analytical Data.- Account and Marketing Data is personal information that can identify individuals and is the principal subject of this Privacy Policy. Account and Marketing Data includes data we collect from visitors to our website, our resellers and customers and other persons with whom we deal with directly.
- Analytical Data relates to the data collected, stored and processed by WayBeyond as to the operation of our customers’ businesses and may include data from devices that monitor and manage our customers’ operations and the location and the size of those operations. Agricultural Data is used by WayBeyond to:
- support the operations of our customers’ businesses
- assist WayBeyond in the development of its products and services, and
- include data on an anonymised and aggregated basis into WayBeyond’s services.
WHEN DOES THIS PRIVACY POLICY APPLY
This privacy policy applies to Account and Marketing Data. For the purposes of the GDPR, to the extent Analytical Data includes personal information, our customers are the data controller when storing or otherwise processing that information and we are the data processor. Our customers determine what and how they collect, use, disclose and transfer Analytical Data. This means our customers’ collection and use of personal information included in Analytical Data is governed by their privacy policy and practices, not ours. We only process Analytical Data as authorised by our customers. Unless required otherwise under applicable law, if we receive any request or enquiry relating to Analytical Data, we will forward this request to our relevant customer. The remainder of this privacy policy does not apply to Analytical Data.CHANGES TO THIS POLICY
We may change this policy by uploading a revised policy onto the website. The change will apply from the date that we upload the revised policy. This policy was last updated on 18 January 2024 to align with the latest legislative changes.WHAT PERSONAL INFORMATION DO WE COLLECT
Directly from you We collect the following information directly from you:- profile data – e.g. your name, address, phone number, email address, date of birth etc
- enquiry data – e.g. information contained in any enquiry you submit to us regarding our goods or services, call us, meet us in person or otherwise contact us
- account data - e.g. your name and email address
- service data – e.g. information collected in the course of the use of our services
- transaction data – e.g. your purchase history and other information relating to transactions made through the website. If you provide your credit card information to us over the phone, we only collect that credit card information where you have freely provided it to process a one-off transaction and once it is complete, we shred any such credit card information. If we send you a link to provide your credit card information, in this situation we use a third party service provider to process credit card transactions and we do not have access to your credit card information. The name of this third party provider will generally be displayed when you are requested to enter your credit card information. You can see further information about how they process your credit card information in their privacy policy.

HOW WE USE YOUR PERSONAL INFORMATION

PROTECTING YOUR PERSONAL INFORMATION
We will take reasonable steps to keep your personal information safe from loss, unauthorised activity, or other misuse. We implement appropriate technical and organisational measures to ensure a level of security appropriate to risks inherent in processing personal information. You play an important role in keeping your personal information secure by maintaining the confidentiality of any password and accounts used in relation to our products and services. You should not disclose your password to third parties. Subject to certain grounds for refusal under applicable law, you have the right to access your readily retrievable personal information that we hold and to request a correction to your personal information. We will take reasonable steps to ensure inaccurate personal data is rectified. If we have shared your personal data with any third party, we will tell them about the rectification where possible.
- right to erasure - where your personal data is no longer needed for the purposes for which you provided it, we delete your personal data when it. You may request that we delete your personal data and we will do so if deletion does not contravene any applicable law. If we have shared your personal data with any third party, we will take reasonable steps to inform those third parties that they must delete your personal data.
- right to withdraw consent - if the basis of our processing of your personal data is consent, you can withdraw that consent at any time.
- right to restrict processing - you may request that we restrict or block the processing of your personal data in certain circumstances. If we have shared your personal data with any third party, we will tell them about this request where possible.

- rights related to autonomous decision-making, including profiling – you have a right to not be subject to a decision based solely on automated processing, including processing, which produces legal effects concerning you or similarly significantly affects you, except where such automated decision-making is necessary for entering into, or the performance of, a contract with you, is authorised by applicable laws or is based on your explicit consent. We do not conduct automated decision-making or profiling.
- right to data portability - you may obtain your personal data from us that you have consented to give us or that is necessary to perform a contract with you. We will provide this personal data in a commonly used, machine-readable and interoperable format to enable data portability to another data controller. Where technically feasible, and at your request, we will transmit your personal data directly to another data controller.
- the right to complain to a supervisory authority - you can report any concerns you have about our privacy practices to your local data protection supervisory authority.
